1. About LAVAYA

LAVAYA is an online gold plated jewellery brand based in Brisbane, Queensland, Australia. We operate exclusively online at lavaya.com.au. We do not have a physical retail store. All orders are placed online and fulfilled by post.

2. Orders & Acceptance

Submitting an order constitutes an offer to purchase. Your order is accepted when we send you an order confirmation email. We reserve the right to:

• Decline any order at our discretion (we will issue a full refund if payment was taken)
• Cancel an order if a product becomes unavailable after purchase (full refund provided)
• Correct pricing errors — if a price displayed was materially incorrect, we will notify you before fulfilment

3. Pricing & Payment

All prices are displayed in Australian Dollars (AUD) and include GST where applicable. International orders may be subject to customs duties and import taxes payable by the recipient — these are not included in our prices.

Payments are processed securely via Stripe. We accept major credit and debit cards. Card details are processed directly by Stripe and are never stored on our servers. Payment is taken at the time of order placement.

4. Products — Gold Plated Jewellery

LAVAYA sells gold plated jewellery. By placing an order, you acknowledge and understand:

• Gold plated jewellery has a base metal coated with a layer of gold. It is distinct from solid gold or gold-filled jewellery.
• Plating may wear over time depending on skin chemistry, exposure to water, perfume, sweat, and frequency of wear.
• Product images are as accurate as possible, but slight variations in colour may occur due to screen calibration.
• Care instructions are provided with each order and on our website. Following them will extend the life of your piece.

5. Shipping & Delivery

We ship Australia-wide and internationally. Estimated delivery times are provided at checkout and are guides only — we are not responsible for delays caused by carriers, customs, or events outside our control.

• Risk of loss passes to you upon delivery to the carrier
• For lost or damaged items in transit, contact us at [email protected] within 14 days of the expected delivery date
• International customers are responsible for all applicable customs duties and import taxes

6. Returns, Refunds & Australian Consumer Law

Our rights and your rights are governed by the Australian Consumer Law (ACL). Nothing in these Terms limits your statutory rights under the ACL.

Change of mind returns:

• We accept returns within 14 days of delivery for unused, unworn items in original packaging
• Return shipping costs are the customer's responsibility for change-of-mind returns
• Bespoke and custom-made pieces are non-refundable unless faulty

Faulty items:

• Contact [email protected] with photos of the fault within 30 days of delivery
• We will offer repair, replacement, or refund at our discretion, consistent with the ACL
• Normal wear and tarnishing of gold plated jewellery does not constitute a fault

7. Bespoke & Custom Orders

Custom and bespoke pieces are made to your specifications. By placing a bespoke order, you agree that: (a) a non-refundable deposit may be required before work commences; (b) the final piece may vary slightly from renders or sketches due to the handcrafted nature of the work; (c) bespoke pieces cannot be returned or refunded unless they contain a manufacturing defect. We will work with you throughout the process to ensure satisfaction.

8. Intellectual Property

All content on lavaya.com.au — including text, images, product photography, brand assets, logos, and design — is the property of LAVAYA and protected by Australian and international copyright laws. You may not reproduce, distribute, or use our content without prior written consent. If you create content featuring LAVAYA products (social media, editorial), we ask you to tag us at @lavaya_fashion.

9. Limitation of Liability

To the maximum extent permitted by law, LAVAYA's liability for any claim arising from your use of this website or purchase of our products is limited to the price paid for the relevant order. We are not liable for indirect, consequential, or special damages. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, warranty, or remedy provided under the ACL that cannot lawfully be excluded.

10. Website Use

You agree to use lavaya.com.au for lawful purposes only. You must not: scrape or harvest data; attempt to gain unauthorised access to any part of the site; transmit harmful code; or use the site in a way that could damage, disable, or impair it. We reserve the right to terminate access for breach of these Terms.

11. Changes to Terms

We may update these Terms from time to time. Continued use of our website or services after changes are posted constitutes acceptance of the revised Terms. The "Last updated" date at the top of this page will reflect any changes.

12. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Queensland, Australia. If any provision of these Terms is found to be unenforceable, it will be severed and the remaining Terms will continue in full force.
